Terms of Service

These Terms of Service govern your access to and use of TheLobby — a private residential community platform for multi-unit buildings. By creating an account or using the app, you agree to these terms. Please read them carefully before proceeding.

1. Acceptance of Terms

By downloading, accessing, or using TheLobby ("the Platform," "we," "us," "our"), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, do not use the Platform.

These terms form a legally binding agreement between you and TheLobby Inc., a company incorporated in the State of Georgia, USA. Your continued use of the Platform after any update to these terms constitutes acceptance of the revised terms.

2. Who Can Use TheLobby

To use TheLobby, you must:

TheLobby is a residential community tool, not a public social network. Access is limited to verified residents and authorized managers of participating buildings. We reserve the right to refuse access to anyone who does not meet these eligibility requirements.

Community membership is building-specific. Your account is tied to your building community. If you move out, your residency status will reflect that change. You are not automatically a member of any other TheLobby community at a new address — you must complete verification at your new building.

You agree to provide accurate, current, and complete information during registration and to update that information as necessary. Providing false information — including a false unit number or impersonating another resident — is a violation of these terms and may result in account restriction.

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at hello@lobbyapp.co if you believe your account has been compromised.

5. Property Manager Accounts

Property managers access TheLobby through a paid plan. Current plan pricing is:

Resident use of the Platform is always free. Property managers are responsible for their subscription fees and for ensuring their billing information is kept current.

Billing and cancellation: Plans are billed annually. Managers may cancel their subscription with at least 30 days' written notice before the renewal date by emailing hello@lobbyapp.co. Annual plan fees are non-refundable. Upon cancellation, the building community will remain accessible to residents in a read-limited state until the end of the paid period, then transition to a restricted feature set.

Plan changes: Upgrades take effect immediately and are prorated. Downgrades take effect at the next renewal date.

Managers are stewards, not owners. Property managers on TheLobby have moderation and announcement tools. They do not own resident data, cannot export resident content, and cannot silently delete posts or permanently ban residents. Their role is defined and bounded by these terms and our moderation policy.

6. Prohibited Conduct

The following conduct is strictly prohibited on TheLobby:

Violations of these rules are subject to enforcement actions as described in Section 8 (Moderation & Enforcement).

7. Content Ownership

You own your content. Posts, comments, messages, photos, and other content you create on TheLobby remain your intellectual property. We do not claim ownership of anything you post.

By posting content on TheLobby, you grant TheLobby Inc. a limited, non-exclusive, royalty-free license to store, display, and distribute that content solely within your building community on the Platform, for the purpose of operating the service. This license does not extend to use of your content in advertising, outside the Platform, or in any commercial context.

You represent that you have the rights to any content you post — including photos and media — and that posting it does not violate any third-party rights or applicable law.

When you delete your account, your content is removed from active display. You may request full deletion of all associated content by contacting hello@lobbyapp.co.

8. Moderation & Enforcement

TheLobby uses a graduated enforcement model. We believe in proportionate consequences — not permanent punishment. No account is ever permanently deleted or banned without the ability to appeal.

What managers can do: Property managers may remove posts flagged as high-severity, promote a resident from probationary to full standing, and submit moderation reports. Managers cannot suspend, delete, or permanently restrict any resident account.

What TheLobby can do: In cases of severe, repeated, or egregious violations — including illegal content, credible threats, or doxxing — TheLobby Inc. may impose temporary access restrictions or, as a last resort, terminate a user's access to the Platform.

All moderation actions are accompanied by a written notice to the affected resident explaining the specific reason for the action. Residents may appeal any moderation decision by emailing hello@lobbyapp.co.

Reported content is never silently removed. Posts under active review are labeled "[This post is being reviewed]" and remain visible to all community members. Residents are notified of the outcome of any report involving their content.

9. Pilot Plan Terms

Buildings joining TheLobby during the pilot period receive a 90-day free trial with full Pro plan features. No credit card is required to start the pilot.

At the end of the 90-day pilot period:

10. Unit Limit Policy

Each TheLobby plan includes a maximum number of resident accounts per building, corresponding to the plan tier. When a building reaches its plan's unit limit:

11. Termination

Residents may delete their account at any time from the Settings screen in the app, or by emailing hello@lobbyapp.co. Account deletion is processed within 30 days.

Property managers may cancel their subscription with 30 days' written notice as described in Section 5. The building community remains accessible to residents for the remainder of the paid period following cancellation.

TheLobby may suspend or terminate access to the Platform — for residents or managers — in cases of serious, repeated, or illegal violations of these terms. We will provide written notice explaining the reason for any such action, and the affected party may appeal to hello@lobbyapp.co.

Upon termination of a property manager's account, TheLobby will make reasonable efforts to notify residents of the building community in advance of any resulting service changes.

12. Disclaimers & Limitation of Liability

TheLobby is provided "as is" and "as available" without warranty of any kind, express or implied. We do not warrant that the Platform will be uninterrupted, error-free, or free of harmful components.

TheLobby is a communications tool for residential communities. We are not responsible for the actions, content, or conduct of any resident, property manager, or third party using the Platform. We do not verify the accuracy of any content posted by users and expressly disclaim liability for any loss or harm arising from reliance on user-generated content.

To the maximum extent permitted by applicable law, TheLobby Inc. and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of data, loss of profits, or personal injury — arising out of or in connection with your use of the Platform, even if we have been advised of the possibility of such damages.

Our total liability to you for any claim arising out of or relating to these terms or your use of the Platform shall not exceed the greater of (a) the amount you paid to TheLobby in the 12 months preceding the claim, or (b) $100 USD.

13. Governing Law

These Terms of Service are governed by and construed in accordance with the laws of the State of Georgia, United States of America, without regard to its conflict of law principles.

Any dispute arising from or relating to these terms or the Platform that cannot be resolved informally shall be subject to the exclusive jurisdiction of the state and federal courts located in Fulton County, Georgia. By using the Platform, you consent to personal jurisdiction in those courts.

14. Changes to These Terms

We may update these Terms of Service from time to time to reflect changes in the Platform, our business, or applicable law. For material changes, we will notify active users via in-app notification at least 14 days before the changes take effect.

The "Last updated" date at the top of this page reflects when the most recent changes were made. Your continued use of the Platform after the effective date of any update constitutes your acceptance of the revised terms.

If you do not agree to the updated terms, you may delete your account before the effective date without penalty.
